Long-awaited Regulations (The Occupational and Personal Pension Schemes (Bankruptcy) Regulations 2002 (SI 2002/427)), implementing the outstanding provisions of the WRAPA regarding the effect of bankruptcy on pension rights, have finally been laid before Parliament and come into force on 6 April 2002.

The Occupational Pension Schemes (Winding Up Notices and Reports etc.) Regulations 2002 (SI 2002/459) have been laid and come into force on 1 April 2002, as provided for by the CSPASSA Commencement No 11 Order.

Implementation of the alternative anti-franking provisions in Part II of Sch 5 of the CSPASSA 2000 has been shelved. Commencement No 9 Order had set 6 April 2002 as the appointed day for coming into force, but Commencement No 11 Order has now revoked this date. This is no real surprise, coming after the DWP’s recent decision to also delay the new MNT Regs, pending the outcome of the Pickering Simplification Review.
